U.S. Must Investigate Policing Methods After Use Of Lethal Force In Missouri

In addition to a prompt, thorough, independent and impartial investigation into allegations that police shot dead an unarmed teenager in Missouri, an investigation into the use of heavy-handed tactics to disperse a wave of protests in the wake of the shooting must be launched without delay, Amnesty International said.

"What is now urgently needed are thorough investigations, not further inflammation, of the incredibly tense situation in the aftermath of Michael Brown being shot dead," said Steve Hawkins, Executive Director at Amnesty International USA.

"Any police officer suspected of having committed unlawful acts must be held to account through effective investigation and, where warranted, prosecution."

"Using excessive force to quell protests is unacceptable. Police in Ferguson must conform to the US Constitution and international standards on the use of force and firearms. Residents must be allowed to peacefully exercise their right to freedom of expression and journalists must not be prevented from carrying out their work."

The call comes after police last night again used tear gas and rubber bullets to disperse a demonstration in Ferguson, the St. Louis suburb where an unarmed African-American teenager, Michael Brown, was shot dead by a police officer on August 9. According to media reports, police arrested at least 10 people during last night's protest, as well as two journalists who were covering the story yesterday afternoon.

On August 13, Amnesty International USA wrote to the Ferguson Police Department in Missouri to express its deep concern over the shooting of Michael Brown and the use of tear gas and rubber bullets at a demonstration against his death on the evening of August 11.

International standards on the use of force and firearms require that police should apply non-violent means before resorting to the use of force. The intentional lethal use of firearms is only permissible if strictly unavoidable in order to protect life.

The organization investigates and exposes abuses, educates and mobilizes the public, and works to protect people wherever justice, freedom, truth and dignity are denied.

    Defend journalism that speaks truth to power from Ferguson to Washington

    Over the past two weeks our nation has watched in horror as a militarized local police force unleashed an assault on peaceful protesters in Ferguson, Missouri, following the killing of an unarmed African American youth. CREDO is working with allies including ColorOfChange to call for justice for Michael Brown.1

    At the same time, there is another crisis unfolding. A crisis that stretches from suburban St. Louis to the U.S. Department of Justice. Law enforcement officials on the streets of Ferguson and along the corridors of power in Washington have, by targeting of journalists for harassment, arrest and possible imprisonment, assaulted a pillar of democracy.

    In an important essay published this week, The Nation makes the connection between Ferguson and White House attacks on journalists and the dangers they pose for democracy. John Nichols writes:

    When journalists are harassed, intimidated, threatened and detained, the basic premise of democracy—that the great mass of people, armed with information and perspective, and empowered to act upon it, will set right that which is made wrong by oligarchs—is assaulted.2

    On the ground in Ferguson, local police authorities have repeatedly intimidated, detained and arrested journalists, creating unreasonable and unconscionable barriers to reporting that tells the story of broader assaults on the civil rights and civil liberties of protesters. Following the police killing of Michael Brown, reporters from the Washington Post and Huffington Post were shockingly roughed up and arrested by police while documenting protest.3 Over the next several days, police shot tear gas canisters at a camera crew, and when the media personnel were forced to flee police shockingly dismantled their camera and lights -- creating a glaring example of a police agency literally shutting down public scrutiny.4 By Tuesday of this week, at least 11 U.S. and foreign journalists had been arrested, while dozens had complained of intimidation by the police.

    Even President Obama had to address the clearly unacceptable physical assaults on journalists in Ferguson saying: “Here in the United States of America, police should not be bullying or arresting journalists who are just trying to do their jobs.”5

    Despite this statement, President Obama has sanctioned a high profile federal attack on journalists, and his administration has invoked the Espionage Act against whistleblowers more times than all previous presidents combined.6

    Nichols makes this connection writing:

    On the very same day that the president was objecting to the bullying of journalists in Ferguson, the Reporters Committee for the Freedom of the Press and other journalism groups demanded that the federal government halt legal actions against New York Times reporter James Risen, who has been threatened with prosecution if he does not reveal the names of confidential sources for his groundbreaking 2006 book, State of War.7

    Our Bill of Rights enshrines the freedom of the press, along with the freedom to assemble peacefully, in the First Amendment to the Constitution. It’s the role of the federal government to defend the Bill of Rights and protect journalists from any entity that would violate the freedom of the press — not to lead the charge to put journalists in jail as it is threatening to do with New York Times reporter James Risen.

    It’s not just journalism that’s at risk, it’s our very democracy. Which is why The Nation and John Nichols are calling for a new movement to defend journalism:

    What is at stake is a free and open society; and it is not enough that the most egregious wrongs have been identified and decried. The culture, the climate, in which those wrongs occur so frequently, must change. It must change because the journalism that goes to places like Ferguson, the gets behind the façade of institutions like the Central Intelligence Agency and the National Security Agency, that demands accountability from street cops and presidents, is much more than an exercise in information gathering. It is the vital link that gives citizens the information they need to bend the arc of history toward justice. There is no middle ground in this regard. Americans are either going to defend speak-truth-to-power journalism and vibrant democracy—as part of a broad reassertion of First Amendment rights—or they are going to have to settle for propaganda and oligarchy.8

    The movement to defend journalism needs to be fought on many fronts. It should seek Congressional action to enact a shield law to protect journalists and whistleblowers. It needs to put in place strong open records and open meetings laws at the local, state and federal level. It ought to ensure law enforcement from the FBI to local police are trained and given clear guidance from the federal government that freedom of the press must be protected. It has to fight to make sure that our judges whether appointed or elected will stand up for the first amendment and put the free speech rights of the people before those of the corporations.

    But first and foremost, this movement must demand that President Obama’s Department of Justice stop attacking journalists via its overzealous Espionage Act prosecutions, and start acting to defend journalists, who are targeted by local and state law enforcement agencies seeking to deprive Americans of the truth.

    “Where assaults on the gatherers and purveyors of popular information occur, those assaults must be challenged immediately,” Nichols writes in The Nation. 9

    GoFundMe: Stop profiting from racially-motivated donors, celebrating Michael Brown's death


    The online fundraising platform GoFundMe is profiting off racially-motivated donors, some of whom are celebrating the police killing of Michael Brown.

     

    Join our campaign demanding that GoFundMe return these profits and take down Darren Wilson fundraising pages.

     

    In the past week, a fundraising effort has been started to support Darren Wilson, the officer responsible for the police killing of Michael Brown.

    They were so successful with their first page, that they’ve started a second page, raising over $300,000 in total, so far. And GoFundMe takes 5% of every donation processed, meaning the company has already made more than $15,000.

    Your own terms of service prohibit "items that promote hate, violence, racial intolerance, or the financial exploitation of a crime.” If Darren Wilson is charged, then it would stand to reason that these fundraisers are in violation of your terms, specifically “financial exploitation of a crime."

     

    GoFundMe should return any money it has made from Darren Wilson fundraising pages, and take them down immediately. Profiting off the killing of Michael Brown is not okay. Profiting off of racially-motivated donors is not okay.

     

    These types of disturbing fundraising efforts have no place on the world's #1 personal fundraising site.

    Bill O'Reilly is a prime example of how racism is based on lower-based ignorance.  Bill O'Reilly, just like most racists, does not know any Black people, have not hung out with any Black people, have not live in any predominately Black community, or anything close to having any real-life experience to base his racist mythology on.  In fact, most White people that actually do have first-hand experience with African America because of friendships or living around Black people[that they actually socialize with], etc., don't usually have such racist perceptions of Black people because their actual socialization with African Americans quickly dispels 99% of the racist ignorance, lies and exaggerations they were told and taught to believe all their life.  

     

    White people actually knowing more than 1 Black person, at the very least, are usually the very ones that know [from actual first-hand knowledge] that Black people are not doing anything White people are not also doing, and that there is nothing happening in most predominately Black communities that is not happening in predominately White communities.

    Update: On August 23rd, President Obama called for a review of federal programs that fund and incentivize wartime arsenals for local police forces. Help us keep up the pressure: tell the Departments of Defense, Homeland Security and Justice to stop funding the militarization of police.

    On August 9th, local police fatally shot an unarmed African-American 18-year-old named Michael Brown in Ferguson, Missouri. In the days that followed, there have been massive protests in Ferguson and heavily armed SWAT teams are roaming the streets in response. Our communities are not war zones.

    And yet the police, armed to the teeth, treat us like the enemy, especially if we're black, young, poor or homeless. Tanks are rolling through our towns. What will it take for police to start protecting communities of color, not waging war on them?

    The Departments of Defense, Homeland Security and Justice are funneling billions of dollars to state and local law enforcement agencies every year to help them purchase military weaponry and equipment. What business do DOD, DHS, and DOJ have funding a war here at home?

    With our country’s long history of aggressive policing in communities of color, it shouldn’t surprise us that these wartime tools and tactics are hitting poor and black neighborhoods hardest. To start undoing the damage, the feds need to stop funding this war.

    Good policing is about trust, which has been severely eroded through the use of excessive force and police brutality. If police forces across America continue to militarize and treat communities of color as the enemy, they will increasingly be seen as an occupying army.

    Stopping the funding and incentivizing of police militarization is a crucial first step to ending this war.

    Tell the Departments of Defense, Homeland Security and Justice: Stop funding the siege on communities of color.

    Tell Walmart: Release the Tapes

    Last month, John Crawford III was killed by police while shopping in a Walmart store.Police were called to the store by another customer who described a “Black male about 6 feet tall” waving a gun. Crawford was actually leaning on a toy pellet gun — barrel pointed down — which he had picked up from one of the store’s shelves.

     

    Walmart has video surveillance footage of the events but has refused repeated requests from John Crawford's family to publicly release the tapes. Join ColorOfChange to demand Walmart release the tapes publicly to ensure justice for John Crawford and help customers and workers feel safe in Walmart stores.

    Our police officers are not our military. Yet military weapons meant for battlefields like the ones I served on as an Army Officer in the Gulf War are being transferred to local police departments around the country. Put simply, these weapons are not intended for local policing and often result in escalating - not solving - situations. We’re seeing this right now in Ferguson, Missouri.

    Many of the weapons being sent to small police departments are coming directly from the Pentagon through the 1033 Weapons Transfer Program. Since its creation, at least $4 billion worth of equipment has been distributed to local police departments through this program.

    Thankfully, the Senate Armed Services Committee is reviewing the Weapons Transfer Program to evaluate how these weapons are being used. However, there’s no reason to continue sending weapons through the program while it's under review. So I’m calling on Defense Secretary Chuck Hagel to temporarily suspend the 1033 Weapons Transfer Program - something he has the power to do. 

    When local police departments have access to armored personnel carriers, mine-resistant ambush protected vehicles, M-4 rifles, camouflage uniforms and assault rifles - we’re clearly seeing the militarization of local law enforcement. But police officers are not at war with American citizens - they are here to serve and protect us. But it only makes sense that if we arm them like soldiers going into battle, they will act like soldiers.

    As a veteran and executive director of Veterans For Peace, I don't want to see our police militarized here at home. And I know many other troops and veterans agree. 

    The program has been suspended before in 2012, when some states actually lost track of military equipment. You read that correctly, these battlefield weapons have actually gone missing before. Yet the program was quietly restarted in 2013. It’s clearly time for a moratorium on the 1033 program while it is under review.
