Wow, great news! Scalia and his shoe shine boy Clarence stop attending Obama, State of the Unions years ago, Scalia the racist, Clarence the coon. Obama can get back in the good graces of people with higher expectations if he goes to war against Republicans and the corporate establishment by fighting like hell to get a real progressive, lefty on the court. 

I have to give Obama some credit because he put Kagan and Sotomayor on the court now he has a shot to add another but his 2 appointments were replacements of liberal Judges, now he gets a chance to tip the majority court to the left. 

I predict the Republicans will run out the clock and not allow Obama appoint another Judge to the court, just to show how much they hate the First Black president of the United States. They will be intent on striking the last blow. In doing so, it will almost guarantee a Democratic will win the presidency.

If Obama wants to make history and nominates a Black woman, that will be a huge dynamic for the Democratic presidential race and it would favor Hillary big time. Let's see what happens.... 

Roberts, Scalia, Kennedy, Thomas and Alito was the conservative majority. 

Kagan, Sotomayor, Ginsberg and Breyer are the liberals.

Kamala Harris is a strong bet to be his nominee and make history appointing the first Black woman to the Supreme Court. Plus it was rumored Obama was checking her out, Michelle caught him googly eyeing her, he said:

“You have to be careful to, first of all, say she is brilliant and she is dedicated and she is tough, and she is exactly what you’d want in anybody who is administering the law, and making sure that everybody is getting a fair shake,” Obama said. “She also happens to be, by far, the best looking attorney general in the country.”

Plus she is a mixed race of Black and East Indian might be appealing to Barack.

Yes, there needs to be a progressive Black woman appointed.  

It's beyond time that a Black woman is appointed to the Supreme Court.

There needs to be a Black woman on the supreme court that will cancel out the Coon factor Clarence Thomas has contaminated the supreme court with, and who will not be afraid to protect the rights of women and/or minorities.

There needs to be an UNBIASED appointee that will actually do what the Supreme Court is Constitutionally required to do, and that is INTERPRET THE LAW and HOW IT SHOULD BE APPLIED, and not someone who is only going to push their personal opinion and/or partisan political agendas.

Isn't it amazing these creeps RUNNING for president, are telling the president not to elect a replacement for the Italian until one of them gets into office. Who says one of them is going to get into office? I've never seen such a batch of men whooping and hollering at each like juveniles running for ANYTHING in my damn life. From where I'm from they're called assholes.

What has happened to the people of this country? It's unbelievable. If The Nazi becomes president, how is he going to interact with Russia and Israel? Is he going to send our kids to die for what mess he creates? Will parents have a say against it?

For all the people who choose leaders, how's it working for them?  Most leaders lead the folks who voted for them to their deaths since I've been on the planet.

The President should appoint his wife to the Supreme Court, that'll make the entire country turn "black" with rage. That would end racism!!

Makes it quite obvious why our Supreme Court has been functioning on such a lower-based level.  It's also evidence that America's Supreme Court is no longer the non-political, non-partisan, unbiased entity that it Constitutionally is REQUIRED to be.  

Also, if you noticed, in Scalia's argument, he's actually referencing"those who contend . . .", (i.e., not necessarily his own opinion or conclusion of facts), which is contrary to his duties of a Supreme Court Justice, which is to deliver a conclusion/ruling based solely on how the Law must be applied to the subject at hand based on the United States Constitution, and the only opinion should be that of his own, which should ONLY explain how the Law must be applied based on his KNOWLEDGE of the United States Constitution.

Since the case before the Supreme Court at the time was:  ". . . University of Texas against a challenge from Abigail Fisher, a white woman from Texas who is suing the university arguing she was denied admission based on her race",  the only issue at hand was whether or not Fisher's race had anything to do with her being denied admission, Scalia's or someone else's opinion on how well Black students did in this college or university or that college or university, was irrelevant.

And by the way, Affirmative Action Law is what actually protects Fisher from being discriminated against in Education, (and Employment, Housing, Wages, etc.), the very same as it does for any minority in America, since women, including White women, are included as a "minority" for the purposes of Affirmative Action Law.  

"Affirmative Action" literally means just that; that employers, schools, colleges, universities, etc., be 'affirmative' or proactive in hiring, recruiting and promoting minorities ("women", including "White women", are considered a minority for the purposes of Affirmative Action Law), so any implementation of Affirmative Action by the University of Texas is actually proof in and of itself that Fisher's claim/complaint is without merit in the first place.

[So, what Scalia was really doing by making such a racist statement, was creating 'a matter of record' of irrelevant Racist Propaganda based on his own [and someone else's] false information, racist ignorance and racist beliefs.]




House Minority Leader Nancy Pelosi said Scalia should recuse himself from any case before the high court involving discrimination.

"It's so disappointing to hear that statement coming from a justice of the Supreme Court," she told Politico. "It clearly shows a bias."

Janai Nelson, associate director-counsel of the NAACP Legal Defense and Educational Fund, was sitting in court when Scalia spoke.

"My first reaction was disbelief and disappointment," Nelson said. "In a case with this much significance, for a Supreme Court justice to make comments that amplify the myth of racial inferiority, is deeply disheartening."

Scalia's comments have also spawned a protest Twitter hashtag, #StayMadAbby, where African-Americans have posted pictures of themselves celebrating their college graduations.

One person who had no visible reaction to Scalia was Justice Clarence Thomas, who rarely speaks during oral arguments.

Justice Scalia Reportedly Spent His Final Days in Texas with an "Elite" Hunting Society

Amid the bizarre conspiracy theories that have emerged over Justice Antonin Scalia's death on February 13, the Washington Post is now reporting an even stranger detail surrounding the late justice's death in West Texas.

According to the Post, 79-year-old Scalia was at Cibolo Creek Ranch in the company of 35 other members of an "exclusive fraternity for hunters called the International Order of St. Hubertus, an Austrian society that dates back to the 1600s." The owner of the ranch, John Poindexter, and Scalia's traveling companion are both high-ranking members of the group, the Post reports.

The story, however, does not officially tie Scalia to the Order.

Members of the worldwide, male-only society wear dark green robesemblazoned with a large cross and the motto "Deum Diligite Animalia Diligentes," which means "Honoring God by honoring His creatures," according to the group's website. Some hold titles, such as Grand Master, Prior and Knight Grand Officer. The Order's name is in honor of Hubert, the patron saint of hunters and fishermen… Poindexter told CultureMap Houstonthat some of the guests dressed in "traditional European shooting attire for the boxed bird shoot competition" and for the shooting of pheasants and chukar, a type of partridge.

According to the group's website, the fraternity calls itself a "true knightly order in the historical tradition." Read the entire report here.


Scalia Routinely Flunked Black Law Students, Displayed Preferential Treatment to Conservatives, University of Chicago Alumni Say

When Supreme Court Justice Antonin Scalia died, many Black people were not sad he passed. His attacks on the Voting Rights Act and disparaging comments about Black students’ academic performance were evidence of his contempt.

But according to Gawker, there is documented evidence of Scalia’s racism as far back as his days as a law professor. Gawker tracked down Black lawyers who took Scalia’s classes at the University of Chicago Law School, and they said even back then they saw evidence of his racism. They claimed Black students in Scalia’s classes received poor grades, but students who were members of the all-white Federalist Society received good grades.

Arnim Johnson took Scalia’s law class at the University of Chicago and was shocked to receive an F. He said receiving a failing grade is largely unheard of at an elite law school.

“While I was there, Scalia was outed as a blatant racist to the extent that the Black American Law Students Association (BALSA) chapter at the law school brought it to the attention of acting Dean Norval Morris in several meetings,” said Johnson in a Facebook post. “Scalia flunked every black student who took his classes that year. Nobody flunks courses in elite law schools. It’s unheard of. He flunked one brother so badly, it skewered his grade average, and he became the first, last, and only student in the history of the school to repeat first year. That man went on to become a respected [sic] military judge.”

Johnson also said Scalia was accused of the same thing at the University of Virginia, although the allegations were difficult to prove. Johnson added that he thought Scalia, who he described as a “a swarthy, son of poor Sicilian immigrants,” was trying to become an “honorary WASP,” by distancing himself from Black people.

However, Johnson later admitted he was mistaken about some of the events that happened 40 years ago. One of the people who he said failed the class, actually passed.

Gawker talked to another former Scalia student. Benn Streeter, who is now an attorney with the Federal Election Commission, said he noticed Scalia giving preferential treatment to the conservative students, who were all white at the time.

“The final exam in the admin law class was the only exam I’d taken at U of C that had a section of short-answer questions … What immediately struck me was that [the] answers were something that had never been covered in class, but it struck me that this was the kind of thing that he would talk to students about if students came by to visit him,” said Streeter.

Phillip Hampton, now senior counsel at Haynes and Boone in Washington, D.C., said he noticed all the Black students in Scalia’s got poor grades.

“It seemed very strange that almost every Black student’s lowest grade was in Scalia’s class,” said Hampton in a phone interview with Gawker. “I don’t think any Black person got more than a C- from Scalia…Black students received D’s and C’s, [and Scalia] failed Arnim [Johnson] along with another Black, very high-achieving student.”

It is clear from Scalia’s comments later in life that he didn’t think much of Black students’ academic prowess. In oral arguments last year, Scalia said affirmative action didn’t help Black students, who would be better off going to “a slower-track school where they do well.”

Scalia’s argument is erroneous for several reasons. Firstly, the Black students he flunked or gave bad grades, evidently must have been smart because they have all gone on to have stellar legal careers. Secondly, many white students get into elite schools, not based on their grade, but because they are legacies who get automatic admission because of their family connections. George W. Bush got into both Yale and Harvard, although he admitted he was an average student. However, his father and grandfather both attended Yale. According to The Huffington Post, a wing of the Yale library is named after Prescott Bush.

And thirdly, many of the students who attend so-called “slower track” schools go there not because they want to, but because that’s all they can afford. Some students don’t want to go elite schools because they don’t want to saddled with a lifetime of debt.

Although the Black students complained about unfair treatment, the university said grading was done on a “blind” basis. But Hampton says Scalia, who said he was a linguist, claimed he could tell Black students by their writing style.

The University of Chicago has issued a blanket denial of Scalia’s alleged unfair grading.

“Because of the length of time that has passed, and the fact that some of the individuals are either deceased or no longer work at the Law School, we are unable to comment on whether the allegations are true,” said a university spokesperson. “ … We would take extremely seriously any such allegation today, and our long-standing policy of blind-grading is intended to minimize the possibility of that kind of misconduct.”
