Flawed Jury Selection Methods Could Favor White Ex-Cop Who Allegedly Raped Black Women

Defense attorneys can be given leeway to choose jurors more likely to side with their client.

Twelve white jurors will ultimately decide if Daniel Holtzclaw, 28, a former Oklahoma City police officer, is guilty of raping and sexually assaulting at least 13 black women, attorneys announced on Tuesday. Holtzclaw is accused of abusing his authority as a police officer to target, pull over and assault black women between the ages of 38 and 54 while on duty.

Final jury selections were made on Tuesday and not only is the jury all-white, but it's also majority-male. This is concerning.

Common strategy submits that a defense team should try to assemble a jury that best suits their client. Prospective jurors first fill out questionnaires, and then the judge and likely the lawyers converse with them. Some potential jurors are eliminated by attorneys on both sides "for cause," such as people who are friends or relatives of the victims or the defendants. People who are or have relatives in law enforcement may also be eliminated, as well as anybody with friends or relatives who have had less than savory encounters with the police.

Attorneys can also use a certain number of "peremptory" challenges to exclude people without giving a reason. These “gut feelings” can bias jury selection and give defense lawyers leeway to choose people who are more likely to side with their clients.

The jury in the Holtzclaw trial consists of eight men and four women, all of whom are white. Three black men were rejected as jurors, according to Patricia Santos, a reporter with ABC affiliate KOCO.

Juries are legally mandated to be representative of the jurisdiction’s demographics. Over half of Oklahoma City’s population is female and 16 percent of the city’s population is black, according to the most recent census data. But that doesn’t mean the entire population is in the eligible jury pool.

Oklahoma has the second-highest incarceration rates for black men in the country. The state also incarcerates more women than any other state in the nation, with 127 of every 100,000 women being locked up -- double the national rate.

This is just one example of how the legal system targets people of color, specifically black Americans, and it has been heavily scrutinized for this bias. 

 

While many cases have attracted scrutiny for jury selection processes that appear to lean heavily on race as a deciding factor, the concerns extend beyond that in the Holtzclaw trial. Rape culture is a pervasive force in our society, which means the jury pool is less likely to understand or empathize with the victims.

The selected group of jurors may find it hard to identify with the victims, with whom they don't share a common racial background, and likely don't share their experience of sexual violence, either. The victim-blaming element gets more complex when the alleged assailant is white and the brutalized person is black and female. 

Misogynoir -- a term coined in 2010 by Moya Baliey describing the intersection of racism and sexism -- is a brutal reality for black women. So even if one of the four white women on the jury has been sexually assaulted, she is still capable of demonizing a black woman as naturally promiscuous and, therefore, "asking for it." 

The bottom line, however, is that Holtzclaw and his alleged victims are products of a society where black women are routinely abused by white men in positions of power. And there are likely more victims than arrest or conviction rates show, since, according to the Department of Justice, for every black woman who reports her rape, at least 15 do not. For white women, at least five do not report their rapes for every white woman who does. The countless black women who have been sexually and physically abused by police officers and other authority figures doesn't help us speak out about this violence. 

This is a complex situation. The Holtzclaw trial is playing out against the backdrop of a broader historical narrative of white men in power targeting and assaulting black women. The selection of a jury that doesn't acknowledge such a history is not unbiased or capable of delivering a fair verdict.

Aren't these things exactly the same tactics that transpired during the entire Slave Trade? Sounds like some Thomas Jefferson shit and only God knows what other "President". This crap's been going on forever. Some white man's probably jacking up a black woman right this minute. Neverending, continuing, jazz!!!!!!

Who, exactly is representing his victims?  What attorney not work the ink on his law degree is not contesting, or allowed in the first place, a jury makeup like that.  

 

It's going to be the Marissa Alexander and Trayvon Martin trials all over again, where the prosecutor is going to deliberately throw the trial to guarantee that no one will have to pay for harming, or brutalizing or raping or even murdering someone Black.  

 

This will be aided by America's racist media that has been trying to 'blackout' the story entirely, because of course, it flies in the face of the racist propaganda that tries to make the world believe that only White women are raped, and that only rapists in America are Black.  

 

Look at how much coverage was given to Cosby's accusers with no evidence whatsoever.  Now compare that to the conscious, deliberate media 'blackout' of this case.

I am wondering how the jury is going to get around the fact that the 10+ Black women victims did not know each other, but all have the same story.  I guess it doesn't matter to the jury.  Facts don't matter!!

  Yep!  The facts don't matter when it comes to black women being systemically abused/raped  since the day setting foot on this supposedly land of milk and honey.  And lemme say this, it doesn't HELP that some ignorant black men in rap videos continue to disrespect and degrade the black women in those films.  So for us?  We are sandwiched in STUPIDITY to the nth,  Because it is and has always been BLACK WOMEN who have supported this nation and gave blood, time and tears to RAISE massa's children along with their own.  How soon they forget how instrumental black women were to their livelihood and set the stage for these monsters to acquire wealth.  

 

Moving forward, my only hope is black men RECOGNIZE the legacy of brilliance in their black women and protect that.  We have been the ones thrown under the bus[before it was a bus] as massa wiped his boots on us during the many times he raped us during slavery, post-reconstruction, Jim Crow and definitely during the transition from segregation to so-called intergation[sp].  

 

They are raping us in white colleges with no accountability...as why they didn't do anything in this case of 10 plus black women.  The lesson?  We need to value ourselves and BLACK MEN need to visually value us and be willing put their lives on it instead of putting lives on a neighborhood block/street  they do not own or pay taxes for but are willingly....willingly ready to die for.  Priorities for black lives should START with us.  Cuz the bottom line?   Massa is really afraid of us...but!  As long as we continue to allow him to do this and pass this horrific act on to his newer generation of males?  This is exactly what we CAN expect in the immediate future.  But!

  Yep it sure has been going on which seems like focking forever.  And now I understand when watching the movie Roots why black women were jumping off the ships to the hungry mouths of the circling sharks.  Cuz they rather die that horrible death than to let massa TOUCH them.    Black men didn't have power then cuz they were chained up right next to the women.  But it appears that somehow when the chains came off their hands and feet it locked on to the brains and sensibilities in terms of protecting their culture.

 

 Just like that black teacher stood and watch that young black girl being slung around the room...and did nothing.  That's how black men were then and how some are now.  Now and then we get a together brotha who will stand in massa's face, like dude at the parent meeting, and tell him straight that this kinda act WOULD not happen around him.  We need more black men to visualize themselves at trial hearings like this.  Let massa know....these are our women, sisters, mothers, aunts, cousins, grandmothers....and to give those motherfockers the evil eye...since they say we got one.  

 

It's a time to let all the shyte out of the bag and for our men to focking protect us...not protect their position at work, or their focking image, or their money or their drug business or their gang business or whatever motherfocking other thang that focking SHOULDN'T matter when it comes to the women in their lives. We bring these men in the world and nurture them to maturity.   Now it's time for these FOOLS to step up and be REAL men in our culture.  Cuz quite frankly, WE NEED THEM TO.  Cuz if women can fight off their predators?  Trust and believe it would be FEW  monster men like massa...left in the world.  But!

OKLAHOMA CITY - One month after being convicted of sex crimes, a former Oklahoma City police officer is asking for a new trial.

In December, a jury convicted former Oklahoma City police officer Daniel Holtzclaw of 18 counts. 

At his trial, 13 alleged victims testified against Holtzclaw, claiming he took advantage of them while he was on duty.

The jury recommended he be sentenced to 263 years in prison for his crimes.

One day before a judge would officially sentence him, Holtzclaw's attorney has filed a motion for a new trial.

In the court documents obtained by KFOR, Holtzclaw's attorney claims his client was denied a fair trial "because the government made deliberate discovery violations and misrepresentations, undermining confidence in the verdict."

Holtzclaw's attorney, Scott Adams, said newly discovered evidence was not disclosed to the defense.

The court documents claim a Facebook post by a police detective referenced evidence that was "withheld from the defense by the government."

The post alleges that there was DNA evidence from several of the victims found in Holtzclaw's car and on his pants.

"The State's witnesses testified under oath that there was only one individual's DNA found anywhere during forensic examination of any material - car, pants, or otherwise, and that belonged to victim [A.G.] - found on Mr. Holtzclaw's pants," the document claims.

It also alleges that it is possible that not all individuals who made allegations against Holtzclaw were disclosed to the defense.

"If there is additional DNA evidence, despite the government's representations to the contrary, and if there are additional people who came forward and falsely claimed that they were victims - yet, for whatever reason their stories were withheld from the defense, despite representations under oath that their stories did not exist - then deliberate misrepresentations were made not only to defense counsel but the Court, calling into question the credibility of the government's entire case," the document claims. "Such reckless discovery violations and misrepresentations to the court undermine confidence in the fairness of Mr. Holtzclaw's trial."

Benjamin Crump, an attorney for the victims said he became aware of the court filing when the media did - less than 24 hours ahead of the expected sentencing.

"Right now, we're concentrating on supporting the victims, getting them through tomorrow, and we'll address that when we get more information about it," Crump told NewsChannel 4. "We anticipate them to make every argument, because lawyers make arguments for their clients."

Crump attended a forum Wednesday night at Langston University's Oklahoma City campus.

More than a hundred people showed up, including the city's police chief, to discuss the Holtzclaw verdict and sexual assault in the African-American community.

A judge will have the final say on the motion for a new trial.

The people who celebrated the jury's verdict are hoping he turns it down.

"It's amazing, in this day and time, you get that many convictions that they would attempt, that they would even consider with that amount evidence and with a jury of your peers recommending 200-plus years, and you ask for a new trial," said Garland Pruitt of Oklahoma City's NAACP chapter. "That's just a waste of taxpayer dollars and skirting justice."
