Bankruptcy Judge Denies Motion to Suspend Detroit Water Shutoffs

Decision Comes As United Nations Delegates Announce 
Investigation into Human Rights Violations

DETROIT, MI— Today, the ACLU of Michigan and NAACP Legal Defense and Educational Fund, Inc., a separate entity from the NAACP, expressed deep disappointment with a federal judge’s decision to deny a motion that would have temporarily stopped water service shut-offs to Detroit residents.

Judge Steven W. Rhodes at the U.S. Bankruptcy Court for the Eastern District of Michigan found he did not have jurisdiction to grant relief to those without water.

“It’s disappointing that Judge Rhodes denied relief to the neediest people, despite recognizing that the City of Detroit has no idea which customers have a long-term inability to afford their water bills,” said Monique Lin-Luse, assistant counsel with the NAACP Legal Defense and Educational Fund, Inc.

The decision came as part of the class action lawsuit brought on behalf of Detroit residents and community organizations affected by the mass shut-offs. The lawsuit argues that the Detroit Water and Sewerage Department (DWSD) began water shut-offs without adequate notice and against the most vulnerable residents, while commercial entities with delinquent accounts were left alone. The ACLU of Michigan and NAACP Legal Defense Fund are serving as expert consultants in the case. 

While the motion to suspend shut-offs was denied, Judge Rhodes cast doubt over whether DWSD's 10 point plan for fixing the city’s water crisis can help those who are living on a fixed income or those who have a long-term inability to pay.

“Thousands of people in Detroit remain without water service, including the elderly, the disabled, and families with small children,” said Kary Moss, ACLU of Michigan executive director. “Without a clear plan for helping people afford their bills or appeal incorrect bills, the water department shouldn’t be in the business of turning off anyone else's water.”

Judge Rhodes also acknowledged that some of the thousands of water shut-offs should have been delayed, particularly for homes with medical needs. He also rejected the argument made by DWSD that people could buy bottled water, which he said is more expensive and difficult for seniors and other vulnerable groups.

The NAACP Legal Defense Fund and ACLU of Michigan continue to call for an end to the mass shutoffs campaign until a comprehensive plan is in place to address the affordability and due process issues plaguing DWSD customers. 

"We have demonstrated, and the judge agreed, that a family without water faces risk of irreparable harm,” said Alice Jennings, Plaintiffs’ counsel and a local attorney. “This fight is not over. We will continue to seek justice for the residents of Detroit.”

In two weeks, an international delegation of United Nations experts will arrive to investigate human rights violations related to water shut-offs and a lack of affordable housing.

To illustrate the problems Detroit residents have faced in attempting to pay their bills, the ACLU of Michigan and NAACP Legal Defense Fund released a six-minute video featuring interviews with residents and activists fighting DWSD’s shut-off campaign.

Nestle CEO Says You Shouldn’t Have The Right to Water

 

Water is essential to the human body and having access to good, clean water, should be a right of every person on this planet. While that is my opinion, the former CEO of Nestle, Peter Brabeck, has a very different opinion and one that might shock you.

 

Brabeck stated rather clearly in an interview for a documentary called “We Feed The World,” that he believes water should not be a public right and that it should be something only the wealthy have access to. A rather interesting statement from the CEO of the 27th largest company in the world, who does over $65 billion in business with a good portion of that coming from bottled water sales.

 

In 2007, Brabeck received a “Black Planet Award” which is an award given to people who contribute to the destruction of the planet. Brabeck, through Nestlé, was accused of proliferating contaminated baby food, monopolizing water resources, and tolerating child labor.

In the interview, Brabeck didn’t stop with water. He continued on talking about GMO’s, nature and corporate responsibility. Feel free to reflect on the statements he makes, and share your thoughts in the comments. Is this the type of world view you want to see in powerful individuals?

 

It was these statements that cause the people of the EU to vote against ever privatizing water. The way in which this sociopath clearly has zero regard for the human race outside of his own wealth and the development of Nestle, who has been caught funding attacks against GMO labeling, can be witnessed when watching and listening to his talk on the issue. This is a company that actually goes into struggling rural areas and extracts the groundwater for their bottled water products, completely destroying the water supply of the area without any compensation. In fact, they actually make rural areas in the United States foot the bill.

 

As reported on by Corporate Watch, Nestle and former CEO Peter Brabeck-Letmathe have a long history of disregarding public health and abusing the environment to take part in the profit of an astounding $35 billion in annual profit from water bottle sales alone. The report states:

“Nestlé production of mineral water involves the abuse of vulnerable water resources. In the Serra da Mantiqueira region of Brazil, home to the “circuit of waters” park whose groundwater has a high mineral content and medicinal properties, over-pumping has resulted in depletion and long-term damage.”

Nestle has also come under fire over the assertion that they are actually conducting business with massive slavery rings. Another Corporate Watch entry details:

“In 2001, Nestlé faced criticism for buying cocoa from the Ivory Coast and Ghana, which may have been produced using child slaves.[58] According to an investigative report by the BBC, hundreds of thousands of children in Mali, Burkina Faso and Togo were being purchased from their destitute parents and shipped to the Ivory Coast, to be sold as slaves to cocoa farms.”

Nestlé is a Swiss multinational. Many infants died throughout Africa due to Nestlé convincing African mothers that their soy milk formula was better than breastfeeding. Primitive white women across the US were also convinced by advertising/propaganda that lab made formulas were better for their babies than breast milk.

Years ago, talking with a sorta revolutionary group, I expressed my take on the hopelessness of political movements due to ego always coming in and ruining the vision.  One of the men said he’d feel like committing suicide if he thought like me. The spiritual side is what sustains me. Rich people most always forget about the poor or where they came from.  Without seeing into greed at a spiritual level, we’re killing ourselves.  This seeing into things is mission critical. IMHO.

 

You have a kind of hope, seems to me, that if we can get rid of the bad guys, things can be fixed. I don’t see bad guys I see the messed up human condition. I agree, the rich rape the poor.  I mean, why even occupy the Middle East? For who, the fat oil companies who benefit?!  We, as a nation, could still get good prices, probably better prices, on oil without going to war and toppling nations for the rich few. The blowback is insanely dangerous. And so it goes.

A question:

What if you see, like above, that there is no reason to occupy and control oil-rich countries. BUT what if another big power goes in and invades and takes over because we left a power-vacuum? I think shit like this shapes decisions. Power incinerates infants, destroys cultures and lives. My take is that the Republicans accept the greedy human power view and Democrats do too but have some ideals which they are willing to compromise.

Now, the greed has gone crazy and almost everyone’s money is shrinking. Isn’t the oligarchy already in control?

Rather than waiting to get crushed, what I came up with is to conduct business with a small group that connects to other small groups in the present-day virtual and global world.  Once you make some $$, you can use it to help others on a local or a global basis.

I have to disagree with you some but I agree with much of what you said. There are countries that are agnostic/atheist but act 10 times more Christian than the United States, who look after their old, young and disadvantaged and do all they can to make sure all of its citizens live in dignity. They have great schools and free college education, universal health care, prison system that try to put its inmates back in society with jobs, training and guidance and their citizens have more freedom than what your typical American can only imagine. 

 

The problem is the United States got the fukked up European settlers, greedy speculators, slavers, exploiters, war mongers and immigrants Europe did not want and to boot many of them were religious zealots and puritans. There is an old saying in Australia "thank God we got the criminals and America got the puritans".

The UN will never work and if it ever does it will be bad. The bigger the governing body the more corrupt it is.

 

We have to be the second power. That's why I say change is a must. Think act globally, bust out, learn about and  conduct business especially including global business in today’s virtual world. 

Its weak because these gaddam Republicans for the primary reasons and Democrats to a great extent have done everything in their power to write laws that particularly benefit the super rich, banks, Wall Street, big corporations controlled by a tiny few billionaires. All these people believe in is short term profits and power at any consequence and doing so they have hollowed out the wealth and resources  from America and its people for themselves. There is no other reason the United States is fading, its all self inflected to obliged a few 100 people. 

 

This is a sick culture that cannibalize itself to kiss the asses of a few, it needs to die, its a right wing, an ignorant idolatrous religious culture that worships MONEY and LUXURY, selfish, that practice plantation trickle down economics, protected by a for profit prison industrial police state, white supremacist culture that will be the death of this experiment. 

 

Americans sense this, know this and Obama was voted in because of Hope and Change, he could have made history and could have been one of the greatest men that have ever lived but he succumbed to the siren of the Oligarchy and kissed their ASSES, I'm disgusted with him and I am PISSED OFF at President Obama because he turned out to be just like any other politician a HOUSE NIGGA! The US has only been blessed with a few GREAT presidents and Obama damn ain't one of them.

 

You can try to defend him all you want, he will go down in history as a president who did not answer the call of history and fought for the wrong side of humanity. It's sad and what a shame, I feel shame for him. 

Years ago, talking with a sorta revolutionary group, I expressed my take on the hopelessness of political movements due to ego always coming in and ruining the vision.  One of the men said he’d feel like committing suicide if he thought like me. The spiritual side is what sustains me. Rich people most always forget about the poor or where they came from.  Without seeing into greed at a spiritual level, we’re killing ourselves.  This seeing into things is mission critical. IMHO.

 

You have a kind of hope, seems to me, that if we can get rid of the bad guys, things can be fixed. I don’t see bad guys I see the messed up human condition. I agree, the rich rape the poor.  I mean, why even occupy the Middle East? For who, the fat oil companies who benefit?!  We, as a nation, could still get good prices, probably better prices, on oil without going to war and toppling nations for the rich few. The blowback is insanely dangerous. And so it goes.    

 

All cultures are sick. There are no good guys on this criminal planet, good guys that run countries.  POTUS Obama is a kind of genius politician but not a great man for the ages. Everyone sells out.  South Africa is immoral and kisses China’s ass. If they do that China will throw them a few silver coins. They’re all Judases.  Genocide is allowed from Rwanda to Tibet to Darfur unless there’s oil involved. It’s a worldwide disease. All politicians sell us out. The little good that is allowed to sneak in are like crumbs we get from massa’s table.  Who to be mad at?  That question got me thinking.

I have to disagree with you some but I agree with much of what you said. There are countries that are agnostic/atheist but act 10 times more Christian than the United States, who look after their old, young and disadvantaged and do all they can to make sure all of its citizens live in dignity. They have great schools and free college education, universal health care, prison system that try to put its inmates back in society with jobs, training and guidance and their citizens have more freedom than what your typical American can only imagine. 

 

The problem is the United States got the fukked up European settlers, greedy speculators, slavers, exploiters, war mongers and immigrants Europe did not want and to boot many of them were religious zealots and puritans. There is an old saying in Australia "thank God we got the criminals and America got the puritans".

The greedy went crazy. They helped to further destroy the US.  A so-called democratic nation should definitely have some care for its people including social cushions and health care. Amazing to see how Fox Propaganda News has convinced nationalistic rednecks  to hate labor unions and vote against their interests like health care. Truth is US citizens have been downgraded to the shit-level and there’s likely no way back.  As for other countries acting 10x more “Christian” than the US, E-Z, how many so-called Christians have the love, loyalty and the gusto for life of any dog? People have sunk below the animal level. The Corporateocracy has less regard for the quality of human life than quarterly profits.  America got the puritans, right!
