An example why Florida is looking pretty stupid.

For the record, I don't have anything the stand your ground law in principle, but these recent cases are why it will probably be in the news for awhile.

What happened to Marissa Alexander sure sounds a lot like 'standing your ground': her abusive husband came after her, choked her, and when she finally broke free, she grabbed a gun fired a single warning shot into ceiling ... so why is she set to serve 20 years in jail?

Well, we imagine her prosecutor Angela Corey, who's also charging George Zimmerman, has the unfulfilling answers. The Florida Times Union's Charles Broward reported on April 21, "A judge denied [Alexander] immunity in a Stand Your Ground hearing. And after a jury found her guilty, she faces a mandatory term of 20 years in prison." Yes, there's the rage-inducing fact that Zimmerman who allegedly pursued and killed Trayvon Martin was allowed to walk free that night while Alexander is going to spend 20 years of her life in prison for a single warning shot. But it's also complex in that, those seeking justice for Trayvon Martin may have to side with a prosecutor who give denies Alexander's (and the NAACP's) plea for a "stand your ground" ruling, like the one that was initially afforded to Zimmerman.

"There's a double standard with stand your ground," says Isaiah Rumlin, president of the Jacksonville Chapter of the NAACP. "The law is applied differently between African-Americans and whites who are involved in these types of cases." As Time's TourÉ points out, "there is one last sliver of hope left for Alexander: the court will soon hear arguments for a retrial." Jacksonville's News 4 added yesterday, "Judge James Daniel set a post-trial motions hearing for 8:30 a.m. Thursday. Daniel said if the motions are denied, she could be sentenced as soon as next week

This is just a damn shame!!!    Unbelievable!! 

 

Zimmerman KILLED somebody ... and wasn't even ARRESTED for almost two months!!  This woman shoots a CEILING .... and was arrested immediately??? 

 

And is being prosecuted more harshly than him by the same prosecutor??? 

 

 

Mannnnnnn .... just when I thought I was going to have a 'non-pissed-off' day today!! 

This has been the consistent problem with laws in America, police and prosecutor discretion, nepotism and racism. This is very clear in Sanford, FL. Then you have black people who still make comments like 'let the system work' when it hasn't been working in our favor at all. I include O.J. in this because though he initially 'got off' for murder, the white power structure ensured that he was set up again to put that 'nigger in his place' in their determination that is jail.

Another thing is black people don't know the law AND don't feel as if we are entitled under the law. I call this the 'Something is better than nothing' effect. Again I have to go back to the history that black people were effectively omitted from knowing the law because of illiteracy AND all we asked for was an arrest and trial rather than a meaningful conviction. We accepted that cold blooded criminals could do what they pleased without fear of prosecution. #endrant

This may sound crazy....... but I'll bet the reason that she was arrested and faces 20 years in prison is that during the verbal and physical fight (fearing for her life) with her abusive husband who physically attacked her first by choking her, when she finally broke free, she THEN grabbed a gun, a gun that wasn't in her actual possession at and during the time of her physical struggle with her husband. 

 

Trayvon/Zimmerman, Zimmerman possessed a gun on his person when he shot/killed an unarmed Trayvon.

 

Tulsa Oklahoma (the 2 White guys who randomly shot/killed/wounded random Black folk) One of the killers reasoned anger was his father was killed by a Black man 2 years ago. That Black man had a gun in his possession (probably unregistered) when he was attacked by the White man. Killed him and got off (no prison time for murder but prison time on illegial gun charges) on Oklahoma's "Stand Your Ground" law.

 

The difference? Having a gun (registered or unregistered) or weapon on your actual person at the time of altercation defending yourself versus not having a gun or weapon on yoir actual person at the time of the initial altercation and then once free, then "seeking" a gun o weapon for your own personal protection.

 

Possible law enforcement rationale? When she finally broke free, why didn't she just get the hell out of there? After she broke free, why didn't she call out, call 911 or scream out loudly for help?

 

Why did she decide to "seek" the gun for protection and take the law into her own hands?

 

"Take the law into your own hands".......illegial.

 

Many women are serving prison sentences for doing exactly what Marissa Alexander did and is being accused of..the only differnce is that they actually shot and killed their attacker/abuser.

I'm not going to go into depth, but let me say this, She didn't know if he was going to further attack or harm her after she broke free. So in essence her case would fall under the guidelines of self defense and the fact that she only fired a warning shot to prevent further attack because the police would not have been there in a reasonable amount of time. So she had to defend herself any way she could.

Marissa Alexander, whose case brought allegations that Florida's Stand Your Ground law is being unfairly applied, was sentenced to 20 years in prison Friday after being convicted of three counts of aggravated assault after firing a warning shot during a dispute with her husband. 

 

The case sparked a confrontation between a congresswoman and the prosecutor after the sentencing in Jacksonville, Fla., WJXT-TV reported.

 

Alexander, 31, claimed she fired a shot from a handgun into the wall to protect herself during a confrontation with her husband, who she said had abused her, WJXT reported. Two children were with him when she fired a shot in his direction, and she was charged with three counts of aggravated assault. 

 

Her attorneys claimed self-defense and cited the state's Stand Your Ground law, which gives people some protection from prosecution for using potentially deadly force in cases in which they feel their life is threatened. The law came under nationwide scrutiny during the Trayvon Martin case, when neighborhood watch volunteer George Zimmerman shot an unarmed teen and authorities waited weeks before charging him.

But a jury agreed with prosecutors that the law didn't apply because she left during the argument, got a gun and returned to confront him, WJXT reported.

Last week, State Attorney Angela Corey, who is also handling the Zimmerman case, said she personally met with Alexander and reviewed the evidence in the case, WJXT reported. She said she offered Alexander a three-year sentence before trial, despite the case qualifying for a 20-year minimum mandatory sentence. 

 

The case has sparked rallies on Alexander's behalf, and WJXT described a heated scene outside the courtroom after the sentencing:

 

"Three years is not mercy and 20 years is not justice," U.S. Rep. Corrine Brown told Corey in an animated confrontation in the hallway. "If there ever was a stand-your-ground case, it was this one."


... She said she has been in contact with some of the best domestic violence attorneys in the country and will be involved in the appeals process.

 

"This is the beginning, not the end," Brown said of Alexander case. "Clearly there is institutional racism."

At issue in the case were Alexander's actions leading up to the firing of the shot.

 

Alexander has said that 36-year-old Rico Gray had physically abused her in a dispute on Aug. 1, 2010. She testified that she fled into a garage and got a gun, but was unable to leave the home because the garage door was stuck. She testified that she went back into the house, where Gray was with his two sons, and fired the shot.

 

But Corey argued that Stand Your Law did not apply because Alexander acted in anger. The judge agreed, saying that by returning to the house, she showed she was not in fear for her life.

 

Gray had been arrested twice on domestic battery allegations, but Alexander had been charged with domestic battery four months after the shooting, Jacksonville.com reported.

 

The 20-year sentence was a mandatory minimum under Florida's "10-20-Life law,"

which mandates sentences for crimes involving a firearm, the Grio.com reported.

 

After the hearing, Alexander's attorney, Kevin Cobbin, said the Stand Your Ground law isn't always applied fairly, NBC station WLTV reported.

 

"The law was made for people like Ms. Alexander," Cobbin said. "They did not make it for people running around on the streets shooting people. They made it for women in their homes trying to defended themselves against abusive mean men."

it seems that justice here in AmeriKKka  has a "hidden" residual that doesn't work for us...! I wonder why!!!!

 

Florida was not admitted into the Union as a Slave State until 1845, prior to that the territory was (filtered thoughout with runaway slaves and Native Americans) owned by Spain.  Source; page 126, 127 "Black Labor, White Wealth" by Dr. Claud Anderson.

 

To this day, Blacks have yet to receive any reparations (In 1970, $12M in land reparations were awarded to the remaining Florida Seminole Tribe.) or honoary recognition for the part they played in bringing Florida into the Union.

 

There is something insidious about this level of dis-enfranchisement on Blacks that is apart of the historical backdrop that affects how they (Blacks) are handled civil-ly and poltical-ly to this very day!

 

We saw how President Bush slipped thru the cracks "illegally".  His brother was the governor  at the time. I always wondered why Jeb picked to be governor of Florida when he was a native of Texas.  The Bush's were way ahead of the game 50 years ago...! 

 

This "stand your ground" mandate was created during Jeb's run of the mill tenure.

 

 

 

Ok so Rep Corrine Brown directly confronted Angela Corey about this case. My impression was that Angela Corey was a special prosecutor brought in for the Trayvon Martin case. Can someone please explain this to me? Specifically WHY Rep. Corrine Brown confronted Angela Corey in public. Also what is very telling is that Angela Corey said that she spoke to leaders, BUT not at one time was Rep Brown invited in for the conversation??? HMMMM What are your thoughts about this???

We can't be surprised, since the "Stand Your Ground" law was not written for us, but rather was written to use against Black people.  This is no more than (as I posted on another site) prosecutorial retaliation for the protests about what happened to Trayvon Martin.  One person pointed out to me that this incident happened before Trayvon Martin was shot.  So What!  If you pay enough attention or just do enough reading or research you will find that a Black person is either railroaded to prison like this woman or is murdered by a cop or some White person supposedly "in self-defense" every time the system is forced to do justice by a Black person through loud protests, or every that a Black person either kills or is found not guilty or acquitted for killing a White person.

 

We are lulled into a distorted view of the numbers of Black people being murdered, maimed, railroaded to prison, and cruelly and unusually punished because of the distance and time between each case.  One week we read about something like this taking place in California, two months later it is happened in Mississippi, a month later it has happened in New York; so, it keeps us from seeing it in terms of how often and actually how great a number it really is, especially when keeping in mind all of the cases that happen in between that we only hear about a year or two years later or after the person has been wasting away in a prison for 15 or 20 years, not to mention the countless amount we never hear of because most Black people lack to money or legal knowledge to fight for justice and because the victims cannot fight for themselves, i.e., dead men tell no tales, and you can't fight an entire system from behind bars.

 

(Since Obama, it seems to be happening even more; 'retaliation' for Obama getting elected, or because of which administration is in office, it is being talked about and/or reported even more.)

 

Too many Black people really do not understand HOW the law is used against us and too many White people want to live on D'Nile about the police, prosecutors, judges and jurors when it comes to Black people, or they deliberately fake as if they do not believe sh!t goes down with Black people in America the way it does with our In-Justice System.

 

This kind of jim crow is going to continue until Black people connect the dots and come together as a group against what is no more than the Lynching of Black people in America.

This is why is is SO important that Black people become a part of the "system" ... learn to play "the game" ... i.e. exercise their rights to VOTE in their local AND state and federal elections.

 

After Ms. Alexander was found guilty of what she was charged with (she had refused a three-year plea deal and opted to go to trial), the judge said he had no discretion to but to sentence her to the minimum punishment of 20 years.

 

That is a direct reflection of the LAWS of the state of Florida.  And those LAWS are formed by people that are elected in to the positions of power to be able to agree on and enact them.  They are the state representatives, governors, states attorneys, judges, DAs and other "representatives" that govern where we live that Black people don't vote for!!

 

For the most part, each individual state determines it's own rules and laws concerning "crime-and-punishment" for individuals deemed to have broken the law.  And in pretty much every state, those laws (and the police forces that enforce them) are targeted against it's Black and poor population. 

 

We KNOW that that goes double down here in the South.  But ... it's also true everywhere else.  The other day I watched a congressional hearing on racial profiling ,,, and the director of the ACLU started spitting out those statistics that were recently posted in another thread about the "stop-and-frisk" policy in New York!!  And I was like ... .

 

But, the fact is ... It's the Mayor of a city (an elected official) who appoints the police chief who sets the direction of the police force .. what they do, where they go, and how they do their jobs.  It's the District Attorney of a city (an elected official) who determines who gets prosecuted ... and for what.  It's the state senates and representatives (elected individuals) that determine the majority of a state's criminal laws.  Also, judges in most districts throughout a state are locally elected to sit on their benches.

 

To STOP that from happening ... Black people - especially in the South - are going to have to take an active role in WORKING HARD to eliminate the current crop of those leading the current racist, narrow-minded, insensitive (in)justice systems throughout the country ... and make conscious and informed decisions to replace them with those willing to be more sensitive about crime, conditions and punishments .. and the reasons they happen in the first place.

 

And yes, it can be done.  A prime example is that of the Dallas D. A., Craig Watkins, who created a unit to investigate all "suspect" cases using DNA evidence ...... who has now exonerated the most wrongfully-convicted inmates of any city in the entire country!!   (Mostly Black men, of course!  )

 

Black people are getting railroaded through the (in)justice systems of this country because there's nothing they can do to stop it.  The "tracks" are already in place to forever send an overwhelming number of Black people into an opportunity-killing, life-destroying cycle of connection to (and in many cases in and out of) the American penal system!!!

Much like the banking system, the criminal justice system was designed in what for us is a lack of justice. It is doing exactly what it was designed to do. Voting to elect more blacks into office to revamp an unjust criminal courts system will do little if any -- perhaps some impact may work at the city or county level, but the state and federal, numerically we don't have the voting block to effect any meaningful change. 

 

For decades now, criminal corporations and the oligarchs have been financing the Democratic and Republican Parties and influencing the selection of its candidates, the party platform, and bribing elected officials via the "leadership." Needless to say most blacks elected to office take their marching orders from these institutions that engineer policy and write laws which are designed to keep us disenfranchised. And mind you these jokers took an oath to maintain that system.

 

Here in California the state had an opportunity to pass Universal Health Care with SB 810. The California State Legislature and Senate is controlled by Democrats. You would think this bill would pass, right? Wrong! The bill was sabotaged by three Hispanics (two are closet Republicans) and a Negro, Roderick Wright -- all Democrats! Wright represents districts with a sizable African American constituency - Compton, Hawthorne, and Inglewood. If there ever were a group of people who would benefit from this bill it's the brothers and sisters in his district. But this shufflin' ass Negro decided to take a bribe from the insurance cartels rather than grant an historic opportunity and natural right to his constituents. So you see, black politicians, much like their white counterparts, aren't going to do a goddamn thing except exploit our vote, maintain the status quo, and fill their coffers with the loot from their puppet masters. 

 

 

 

Your Roderick Wright example is why I believe that most of the people holding political positions, especially those that have been in that position for decades, and more especially Black people that rely on Black votes, should be replaced, and should continue to be replaced each and every term that they sit and vote against the interests of Black people, period.  


As far as the laws are concerned, it is usually at the State and City levels that Black people receive the harshest and most unjust treatment.  Really, in most cases, it is not really the law(s), it is the policing, judging and sentencing of the laws, with the exception of Mandatory Minimums, of course.
